Terms and Conditions




                                                          MOSS WOOD CARAVAN PARK  

 

PARK RULES – 1977, amended May 1982, October 1993, June 1996, January 2004 .

 

1.      The speed limit within the park is 5 m.p.h. and must be strictly observed in the interests of safety of other park users.  Only holders of a current Driving Licence and Insurance are permitted to drive any vehicle within the park. Outside the park, on

Crimbles Lane
, and other local roads beware of the unexpected. 

 

2.       Motor vehicles are permitted on the Park at the rate of one per caravan.  Other motor vehicles are allowed to park at the discretion of the Park Owners and shall be parked as and where directed.  Commercial vehicles are allowed on the park only with prior consent of the Park Owners and must parked as directed.

 

3.       A fire extinguisher of a minimum capacity of 1.5 kg dry powder, of a standard approved by the Fire Officers Committee and to British Standard Specification, shall be provided in each caravan in a prominent position and maintained in a viable working condition.

 

4.       Dogs and domestic pets are allowed on the park with prior consent of the Park Owners and subject to the following :-  they are kept under control, are not a nuisance or danger, they are not left unattended in caravans and are kept on a short lead when outside the caravan. Dogs are not allowed in the children’s play area, office, shop or the toilets.  All ‘accidents’ must be cleared up in order to safeguard public health. Dogs and cats belonging to visitors, are not allowed on the park.

 

5.       Washing may be dried outside on weekdays from Monday to Friday, but not at weekends or Bank Holidays. In the interest of safety, washing lines are not permitted, washing should be hung only on approved window bracket frames located on the entrance door side of the caravan.

 

6.       The space underneath each caravan and the immediate vicinity must be kept clean and tidy.  The caravan owner is responsible for trimming the vegetation for a strip 9” wide around the perimeter of the caravan.  Grass cuttings and garden debris must be disposed of as directed by the Park Owners.

 

7.       The planting of small shrubs and flowers is approved and encouraged in a border 3ft wide at the front and near side of each caravan.

 

8.       The topping, pruning or felling of any tree or shrub is not permitted for any reason; where and when necessary, any ‘surgery’ will be carried out only by the park employees.

 

9.       External structures around and between caravans, such as sheds, storage boxes, decking, balconies and fencing can be subject to the constraints of the Site Licence, Fire Regulations and Planning Regulations. Prior approval of the Park Owners is therefore required before erecting any such structure on the caravan pitch. 

 

10.   The land around the Park is intensively farmed; all patrons of the Park and their visitors must

not trespass on adjoining land for any purpose whatsoever. Please observe the ‘Country Code’.

 

11. The privacy, convenience and enjoyment of other caravan owners must be respected. From     the hour of , noise or disturbance for any reason must be kept to a minimum.

11.   Radios, televisions, record players and musical instruments must not be operated in a manner likely to cause annoyance to others users of the park.

 

13. The use of any caravan is restricted to the owner, his immediate family and his bona-fide guests.  Sub- letting is not permitted. For security reasons, when anyone other than the owner is using a caravan, the Park Owners must be informed in advance, of the name and address of all persons using the caravan.

 

14. Guns, firearms or weapons of any type are not allowed on the Park, and the pursuit of game or setting traps is prohibited.

 

15. Plastic bags are available on request for the disposal of refuse, which must be placed in the green Eurobins located adjacent to the workshop, the toilet block and also near the office.  Every effort should be made to compact and reduce the bulk of your refuse. Full refuse bags should not be left on the ground, it attracts the attention of dogs, cats and vermin: and also looks unsightly. For their safety! Do not send young children to use the refuse bins. Please make use of the re-cycling bins where appropriate.

 

16. The water, electricity and gas supplies to your caravan should be turned off whenever the caravan is left unattended.  No responsibility will be accepted by the Park Owners, for any accident, leakage, or damage, arising as a result of connection to the site services.  Caravan owners are responsible for the frost damage protection in respect of their caravans.

 

17. The electricity supply is limited to approximately 16 amps.  If the service is overloaded causing the circuit breaker to trip, a call out and re-connection fee of £5-00 will be charged.  Stakes or ground anchors must not be driven in to the ground without first consulting the Park Owners.  Serious damage could be caused to the services and maybe to yourselves.

 

18. Bottled gas supplies should be ordered and paid for before mid-day and will be delivered before .  All deliveries requested out of these hours will be subject to a price surcharge.  It is recommended that caravans should be equipped with an extra cylinder and changeover regulator, to avoid running short of gas.

 

19. A dedicated children’s play area is provided adjacent to the touring park and a four acre field is available for ball games. In order to avoid disturbance to others and the possibility of accidents, ball games are not allowed within the caravan areas. The play areas are unsupervised and must not be used after sunset. At all times, young children should be under the supervision and control of a responsible adult.

 

 20. In the interests of security, all persons visiting the park by invitation of caravan owners or for

       the purpose of trade, buying or selling, repair, deliveries or other work must first report to 

       the office.  The park owners reserve the right to refuse permission for access.

       Argos delivery vehicles are not permitted on the park for any reason!

       

 21. Fats, oils, strong detergents and disinfectants upset the biological treatment process in the                    sewage treatment plant and should not be poured into our drainage system. Rags, nappies, discarded clothing, can block our pumps and most plastics are not biodegradable; please dispose of other than down the drains. 

 

22. The Owners reserve the right to amend these Rules in the interests of good park management.

LICENCE CONDITIONS

 

   Tenure.

 

L. 1. The first purchaser of a new caravan purchased from or through the park Owners will have the right of renewal of the annual pitch licence in respect of that caravan for a period of ten (10) years from the date of purchase, subject to:-

 

a.       Prompt and Full payment of the Pitch Fee, Rates, Electricity Charges and other accounts in respect of the occupancy of a pitch, by the due date.

b.       The strict observance of the Park Rules from time to time in existence on the park, by the caravan owner, his family, all his visitors and guests.

c.       The caravan being maintained in clean, tidy condition, in good repair and in manufacturers original colours.    

 

L. 2. It is not intended that payment of pitch fees by a caravan owner or the occupancy of a pitch will    in any way create the relationship of Landlord and Tenant.  The legal possession and control of all parts of the park and of any pitch shall at all times remain vested in the Park Owners.

 

L. 3. The permission to occupy a pitch is personal to you and may not be assigned or underlet.

 

 L.4. Pitch fees are payable annually in advance and become due upon the 1st January each year.  Upon full payment thereof the Park Owners will give licence to occupy a pitch up to 31st December in the year of payment.  Thereafter the continued use of the same pitch is conditional on the prompt and full payment of all fees, rates, and other outgoings relating to the occupancy of the pitch by the due date. 

The licensed holiday season is from 1st March to 31st October in each year. 

Occupation of caravans is not permitted during the closed season, nor must they be used as the sole or main residence of the owner.

     

L. 5. The caravan owner will permit the park owners to remove the caravan from the pitch, at their expense, should the necessity arise due to any unforeseen emergency.  Whenever possible we will use our best endeavours to give 7 days notice of such movement. Should it be necessary to move the caravan to another pitch due to park re-development, or in order to maintain the standards of the park, 28 days written notice will be given and we will endeavour to provide an equally commodious alternative pitch. However, if due to such re-location, the caravan owner decides to relinquish the pitch licence and leave the park, an apportioned amount of the pitch fee will be returned to the caravan owner.  

 

L. 6. Caravans over ten years old are not eligible for resale on the park, but may remain on the park subject to annual agreement by the Park Owners, and subject to continued maintenance of the caravan in a good saleable condition.

   

 

 

 

 

 

 

 

 

 

 

4 .

 

Insurance.

  

I. 1.  All caravans stationed on the park must be fully insured against all usual risks, including fire, storm, third party and public liability for adequate sums (not less than £2 million).The caravan owner will provide evidence of the insurance cover, where it is not arranged by the Park.

                                                                         

I. 2. The Caravan owner must indemnify the Park Owners from all actions proceedings and claims in respect of any damage or liability caused by or arising from any wilful act, neglect or default of the Caravan Owner or any occupant of the caravan or any person who might be at the Park or on the pitch at the invitation expressed or implied by the Caravan Owner.  Under no circumstances will the park Owners make good, accept responsibility, or liability in respect of damage, theft, or loss of or to any caravan, motor vehicle or any article therein, or any other equipment or property brought to or left upon the caravan park by the Caravan Owner, his family or his guests from any cause whatsoever and the Caravan Owner indemnifies the Park Owners and their employees and guests in this respect.

 

Charges

 

C.1.A revised list of charges will be published from time to time and will be circulated to all current principal licence holders.  The Park Owners expressly reserve the right to alter all charges after due notice. Any increases in pitch fees will reflect the retail price or cost of living index, inflation, park expenditure, staff wages, salaries, the length of the season or any other relevant factor. Statutory charges such as rates, VAT, electricity and environmental charges will be introduced and amended as required by law.

 

C. 2.Payment of all accounts and charges shall unless otherwise agreed in writing, be made within 28 days of the invoice date.  Any licence holder who had been formally notified of failure to comply with the payment conditions, will, after a period of fourteen days, forfeit their licence.  Licences will only be reinstated at the discretion of the Park Owners.

 

C. 3.If any caravan remains in occupation of a pitch after the expiry or termination of a Licence, the Park Owners may give formal written notification to the principle owner of their intention to remove the caravan to a place of storage.  Such removal may take place at any time following an interval of seven days thereafter.  All costs of removal of the caravan and reinstatement of the pitch, will become the responsibility of the former licence holder(s).

 

C. 4.Charges commence :-

 

a.       When a caravan is first occupied.

             b.   When a Licence is transferred to a new caravan owner.

 

All charges run until the expiry of the Licence, or agreed termination of the Licence by either party, or until the caravan is removed from the park (not just the pitch), whichever is the later.

 

C. 6.If charges are not settled in accordance with these conditions, licence holders are liable to pay the Park Owners for the collection, legal, and other costs incurred in obtaining settlement.  Caravan owners are liable to a penalty charge if any cheque or other remittance is not honoured on presentation.  Any interest charged will be at bank base rate plus 5%.

Termination of the Pitch Licence.

    

T.1.A caravan owner who intends to relinquish the pitch licence may do so by giving 28                                                                                 days written notice of his intention to the park owners; unless there are valid unforeseen circumstances necessitating shorter notice.

                                                                                                                                                     

T.2. Where the Licence is terminated by us, we will repay to you any pitch fees you have already paid              in respect of the un-expired period after the removal of the caravan. If you decide to terminate the licence before the 30th day of June we will refund to you 50% of the pitch fees.

 

T.3 .Where you terminate the Licence after the 30th day of June there will be no refund payable.

As we are unable to reclaim Rates paid to the Local Authority, no refunds of Rates can be made.                            

 

T.4.Any persistent or serious breaches of the Park Rules, unreasonable behaviour or criminal activity will lead to termination of the pitch licence.

 

T.5 .If after the expiry or termination of a pitch licence, the caravan or any property or goods belonging to the former licence holder, or caravan owner, remains on the park and such persons fail to remove them within 21 days of formal notification, the Park Owner may as agent, retain the right to hold the caravan property or goods and the power of sale thereof, for any outstanding sums due to us upon termination and we will be entitled to deduct from any proceeds of the sale due to you, all sums due to us together with the costs of sale and storage.    

 

Sale or Disposal of Caravans

 

If you wish to sell your caravan on the park, you may do so with the Park Owners acting as sole selling agents, providing that :-

 

a.       The caravan is less than 10 years old and in sound merchantable condition.

b.       You give a first option to purchase to the Park owner, in writing, at a fair market price subject to condition; and at a discount.  Such option to be exercised within 7 days.

c.       Notwithstanding that such an offer has not been taken up by the Park Owners, the caravan owner shall not sell the caravan at a lower price than that which was offered to the Park Owner, without first re-offering the caravan for sale to the Park Owners at that lower price; which offer may be accepted by the Park Owners.

d.       Upon successful completion of a sale, a commission, transfer fee, or discount, not exceeding 15% of the agreed re-sale price, plus VAT where applicable, will become due to the park owners. All sale transactions must be through the Park office.

             f.   There is no restriction to the sale of the caravan off the park.

 

Upon relinquishing the occupancy of a pitch, the pitch must be left in a clean and tidy condition, the caravan owner will become liable for the costs of disconnecting the services, removal of the caravan from the pitch, making the caravan ready for transport, and any clean up or reinstatement of the pitch. Charges will be based on time and costs incurred by us in the process.
